Tribunal orders city firm to pay workforce
A specialist Dundee demolition company that has gone into receivership with the loss of more than 20 jobs, has been ordered to pay its workforce 90 days’ pay (writes Graeme Strachan).
An employment tribunal in Dundee judged that Trojan Ltd had failed to consult or give any warning to staff that redundancies were a possibility and make a protective award in respect of those employees.

Anthony Holt, of Balbeggie Street, took his case to the employment tribunal after the news was broken to a stunned workforce at the company’s North Isla Street premises on February 14.

Mr Holt was a demolition operative with the company from 1990 and, following his termination of employment, he submitted a claim for a protective award.

He had been working at a job at Kirriemuir when he was summoned to the yard in Dundee with the other employees and addressed by representatives of Tenon Recovery.

They were advised that Trojan had gone into receivership and that they should lock up their vehicles, hand over the keys and go home.

Mr Holt said he had not been consulted or warned in any way that redundancy was a possibility or that the company was in financial difficulty.

Following the termination of his contract, he was sent a letter from Tenon Recovery advising him to seek recovery for any sums due to him from the Secretary of State.

Employment judge Ian McFatridge said it was clear from the evidence that Trojan had failed to comply with the requirements of section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992.

He said it was clear that a number of employees were also made redundant on the same date and in the same circumstances.

He therefore thought it appropriate to make the same award of 90 days’ pay to all employees made redundant from the Dundee establishment on February 14.
